Common use of Non-Participation Clause in Contracts

Non-Participation. In the event a non-acquiring party fails to timely elect to participate in acquired leasehold interest pursuant to Section 7.2, then such oil and gas leasehold interest shall not become subject to this Agreement, shall be held solely by the acquiring party and shall not in any manner be subject to the terms of this Agreement.
