Common use of Non-Performance of Covenants Clause in Contracts

Non-Performance of Covenants. The failure of Pledgor or any Obligated Party to timely and properly observe, keep or perform any covenant, agreement, warranty or condition required herein or in any other Loan Documents, to the extent such Default shall not have been remedied or waived within 30 days after the earlier of the knowledge of any officer of the Pledgor of such breach or failure and the date the Secured Party gives Pledgor written notice of the Default; or

Non-Performance of Covenants. The failure of Pledgor or any Obligated Party to timely and properly observe, keep or perform (i) any covenant, agreement, warranty or condition contained in Sections 7(a), 7(e) or 8 or (ii) any other covenant, agreement, warranty or condition required herein or and, in any other Loan Documentsthe case of (ii), to the extent such Default failure shall not have been remedied or waived within 30 days after the earlier of the knowledge of any officer of the Pledgor of such breach or failure and the date the Secured Party gives Pledgor written notice of the Defaultcontinue for fifteen (15) days; or

Non-Performance of Covenants. The failure of either Pledgor or any Obligated Party to timely and properly observe, keep or perform any covenant, agreement, warranty or condition required herein or in any of the other Loan Documents, to the extent Documents and such Default shall failure is not have been remedied or waived cured within 30 ten (10) days after the earlier of the knowledge of any officer of the Pledgor Pledgors become aware or should have become aware of such breach or failure and the date the Secured Party gives Pledgor written notice of the Defaultfailure; or

Non-Performance of Covenants. The failure of Pledgor or any Obligated Party to timely and properly observe, keep or perform any covenant, agreement, warranty or condition required herein or in any of the other Loan Documents, to the extent Related Documents and such Default shall not have been remedied or waived within failure continues for a period of 30 days or more after the earlier of the knowledge of any officer of the Pledgor of such breach or failure and the date written notice by the Secured Party gives to the Pledgor written notice of the Defaultor any Obligated Party; or
