Non-Prejudicial Acceptance Sample Clauses

Non-Prejudicial Acceptance. Notwithstanding anything herein to the contrary, DNA agrees that VISTA's or its designee's (i) failure to inspect or discover any nonconformity with respect to the Information and Materials or Transfer of the Information and Materials, (ii) inspection of all or less than all of the Information and Materials, or (iii) approval, acceptance or payment by VISTA of or for the Information and Materials, is without prejudice to any rights, remedies or entitlements VISTA may have under this Transfer Agreement, at law, in equity or otherwise, and shall not relieve DNA from any obligations under any warranties, representations, covenants or obligations hereunder, express or implied.
