Common use of Non-Recourse Parties Clause in Contracts

Non-Recourse Parties. Notwithstanding any provision of this Agreement or otherwise, the parties to this Agreement agree on their own behalf and on behalf of their respective Subsidiaries and Affiliates that no Non-Recourse Party of a party to this Agreement shall have any liability relating to this Agreement or any of the transactions contemplated herein except to the extent agreed to in writing by such Non-Recourse Party.

Non-Recourse Parties. Notwithstanding any provision of this Agreement or otherwise, without limiting claims for Fraud, the parties to this Agreement agree on their own behalf and on behalf of their respective Subsidiaries and Affiliates that no Non-Recourse Party of a party to this Agreement shall have any liability relating to this Agreement or any of the transactions contemplated herein except to the extent agreed to in writing by such Non-Recourse PartyParty or pursuant to a Letter of Transmittal, the Support Agreement or a Restrictive Covenant Agreement.
