Common use of Non-Solicitation of Customers and Suppliers Clause in Contracts

Non-Solicitation of Customers and Suppliers. During the period of Executive's employment by the Company and, if Executive's employment is terminated under Sections 5(a), (b) or (c) above (and provided the Company fulfills its obligations thereunder) until the second anniversary of the date of Executive's employment termination, or if Executive's employment is terminated under Section 5(d), the Non-Competition Period, Executive shall not, directly or indirectly, influence or attempt to influence customers or suppliers of the Company or any of its subsidiaries or affiliates to divert any of their business to any Competitor of the Company.

During the period of Executive's employment by the Company and, if Executive's employment is terminated under Sections 5(a), (b) or (c) 5 above (and provided the Company fulfills its obligations thereunderthere under) until the second anniversary 6 month of the date of Executive's employment termination, termination or for the period of one year thereafter if Executive's employment is terminated under so elected by the Company pursuant to Section 5(d), the Non-Competition Period6. (d) below, Executive shall not, directly or indirectly, influence or attempt to influence customers or suppliers of the Company or any of its subsidiaries or affiliates to divert any of their business to any Competitor of the Company.
