Non-State Agency. The Contractor may conduct credit evaluations for Non-State Agencies intending to use the Contract and deny services to Non-State Agencies that do not meet the Bidder’s standard commercial risk qualifications. The successful Contractor shall notify the Non-State Agency in writing that their use of the Contract has been denied based on an unsatisfactory credit rating.
Non-State Agency. The provider agrees to indemnify, serve and hold harmless the System, its officer, employees, successors and assigns, from any and all third-party claims of any nature, including claims of attorney fees and costs, arising out of or relating to Provider’s performance of this contract, such indemnification obligation to be limited to the insurance coverage described in Section 7 (b).
