Common use of Non-Waiver of Defaults Clause in Contracts

Non-Waiver of Defaults. Any failure of UTMB to enforce or require the strict keeping and performance of any of the terms and conditions of the Contract, or to exercise a right hereunder, shall not constitute a waiver of such terms, conditions, or rights, and shall not affect or impair the same, or the right of UTMB at any time to avail itself of the same.
