Common use of Non-Waivers Clause in Contracts

Non-Waivers. A failure or delay of either Party to enforce any of the provisions hereof, to exercise any option which is herein provided, or to require performance of any of the provisions hereof shall in no way be construed to be a waiver of such provisions or options, and each Party, notwithstanding such failure, shall have the right thereafter to insist upon the performance of any and all of the provisions of this Agreement.

A failure or delay of Failure by either Party to enforce insist upon strict performance of any of the provisions hereof, or either Party's failure or delay in exercising any rights or remedies provided herein or by law, shall not release either Party from any of its obligations under this Agreement, shall not be deemed a waiver of any rights of the Parties to exercise insist upon strict performance hereof or any option which is herein providedof its rights or remedies under this Agreement or by law, or to require performance and shall not operate as a waiver of any of the provisions hereof shall in no way be construed to be a waiver of such provisions or options, and each Party, notwithstanding such failure, shall have the right thereafter to insist upon the performance of any and all of the provisions of this Agreementhereof.
