Common use of Nondisparagement Clause in Contracts

Nondisparagement. Executive agrees that Executive will not in any way, directly or indirectly, do or say anything at any time which disparages the Company, its business interests or reputation, or that of any of the other Released Parties.

The Company agrees that its current executive officers and Board of Directors, for so long as they are employed by, or serve as directors of, the Company, shall not make any written or oral statement intended to disparage Executive or Executive’s business reputation. Nothing in this section shall prohibit Executive from providing truthful information in response to a subpoena or other legal process.

Likewise, the Company, through its directors and senior management, will not in any way, directly or indirectly, do or say anything at any time which disparages Executive or his business interests or reputation.
