Common use of NONEXISTENCE OF BENEFICIARY Clause in Contracts

NONEXISTENCE OF BENEFICIARY. Any portion of the amount payable hereunder which is not disposed of because of the Participant's or former Participant's failure to designate a beneficiary, or because all of the Designated Beneficiaries predeceased the Participant, shall be paid to his or her Spouse. If the Participant had no Spouse at the time of death, payment shall be made to the personal representative of his or her estate in a lump sum.
