Common use of Nonperformance of Covenants Clause in Contracts

Nonperformance of Covenants. Any covenant, agreement or condition herein or in any other Loan Document (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtedness) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and cure period (if any) provided for herein or in such other Loan Document.

Nonperformance of Covenants. Any covenant, agreement or condition herein or in any other Loan Document (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtedness) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and cure period (if any) provided for herein herein, in Article VII of the Loan Agreement, or in such any other Loan Document.

Nonperformance of Covenants. Any covenant, agreement or condition herein or in any other Loan Document (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtednesssecured indebtedness) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and grace or cure period (if any) provided for herein or in such other Loan DocumentSection 4.2 of this Security Instrument.

Any covenant, agreement or condition herein or in any other Loan Document Paper (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtedness) is not fully and timely performed, observed or kept, and (i) any such failure under this Mortgage is not cured within thirty (30) days or (ii) any such failure under any other Loan Paper is not cured within the applicable notice and cure grace period (if any) provided for herein or in such other Loan DocumentPaper.

Nonperformance of Covenants. Any covenant, agreement or condition herein or in any other Loan Document this Mortgage (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtedness) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and cure period (if any) provided for herein or in such other Loan Documentthis Mortgage.

Nonperformance of Covenants. Any covenant, agreement or --------------------------- condition herein or in any other Loan Credit Document (other than the financial covenants listed in Section 9.1(t) and covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured IndebtednessIndebtedness evidenced by the Notes and this Agreement) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and grace or cure period (if any) provided for herein or in such other Loan DocumentSection 9.2 of this Agreement.

Nonperformance of Covenants. Any covenant, agreement or condition herein or in any other Loan Document (other than covenants otherwise addressed in another paragraph of this Section, such as covenants to pay the Secured Indebtedness) is not fully and timely performed, observed or kept, and such failure is not cured within the applicable notice and cure period (if any) provided for herein herein, in the Loan Agreement, or in such any other Loan Document. If no notice or grace period is so provided, then subsection (l) below shall apply.
