Nonsurvival of Representations. None of the representations and warranties contained in this Agreement or in any certificate, instrument or other writing delivered pursuant to this Agreement will survive the Merger or the termination of this Agreement. Only the covenants contained in ARTICLE I, ARTICLE II and ARTICLE IX, and SECTIONS 6.5, 6.6 and 8.4 will survive the Effective Time.
