Not Binding. This Agreement will not be binding upon the parties until it has been signed below on behalf of each party by a duly authorized representative.
Not Binding. This Amendment shall not be binding upon the parties hereto unless and until executed and delivered by all parties hereto and the closing of the Construction Loan occurs.
Not Binding. Neither party nor its respective Affiliates shall be responsible or bound by any settlement made by the other party without its prior written consent.
Not Binding. The DNRC shall have full and unfettered discretion on whether or not to contract with a Proposed Party. The DNRC may follow its internal processes and procedures to determine whom to award the contract; however, in no case shall the DNRC be liable to the Finder, the Proposed Party, or any other for awarding the contract to another. The DNRC may withdraw the real property from public consideration at any time, without liability.
Not Binding. It is understood and agreed that this Lease is submitted to the Tenant for signature with the understanding that it shall not bind the Owner unless and until it has been executed by the Owner and delivered to the Tenant or Tenant's attorney.
Not Binding. Not Binding. This Amendment is being tendered to Tenant without obligation on Landlord’s part and in no event shall it be deemed to be binding upon Landlord or give Tenant any rights unless and until Landlord shall have executed the same and delivered a copy to Tenant.
Not Binding. The submission of this Lease to Tenant shall not be construed as an offer or a binding agreement, nor shall the Tenant have any rights with respect thereto, unless and until landlord shall execute a copy of this Lease and unconditionally deliver same to Tenant.
Not Binding. This MOU is not intended to be legally binding on any of the “Reform Parties” nor is the MOU intended to confer any benefit on any of the “Reform Parties”
Not Binding. Tenant acknowledges that this Agreement shall not be binding on Landlord or Tenant until Landlord and Tenant shall each have executed this Agreement and a counterpart thereof shall have been delivered to the other.
