Common use of Not Force Majeure Events Clause in Contracts

Not Force Majeure Events. Any obligations of either Party which arose before the occurrence of the Force Majeure event causing non-performance shall not be excused as a result of the occurrence of a Force Majeure event. The late payment of money owed or the damage or disability resulting from a failure of a Party to utilize Good Utility Practice is not excused by Force Majeure.
