Common use of Notice and Bargaining Clause in Contracts

Notice and Bargaining. Where the Employer intends to make a technological change that: (a) Affects the terms and conditions or security, of employment of a significant number of Employees to whom the Collective Agreement applies; and (b) Alters significantly the basis upon which the Collective Agreement was negotiated. It shall give sixty (60) days' notice in writing to the Employees' bargaining agent of the technological change, and the Employer and the Employees' bargaining agent shall, within fourteen (14) days of the date of notice, commence collective bargaining for the purpose of reaching agreement as to the adjustment to the effects of the technological change and in what way, if any, the Collective Agreement should be amended.
