Common use of Notice and Confirmation Clause in Contracts

Notice and Confirmation. Following the occurrence of any event of Force Majeure the FM Affected Party shall immediately notify the other Party by telephone or facsimile of the occurrence and the expected extent and duration of such event of Force Majeure and shall promptly afterwards give evidence with reasonably full particulars of such event of Force Majeure. The occurrence (with reasonably full particulars) and duration of an event of Force Majeure may be confirmed by a certificate of a Chamber of Commerce or certificate of the competent governmental authorities of the country where the event of Force Majeure occurred. Such confirmation shall not prejudice the right of either Party to dispute the Force Majeure claim and to initiate arbitration proceedings under Article 11 with respect to the matter.
