Notice of Environmental Matters. Promptly, but in any event within sixty (60) Business Days from the date the Lessee has actual knowledge thereof, the Lessee shall provide to the Lessor written notice of any pending or threatened claim, action or proceeding involving any Environmental Violation on or in connection with the Property. All such notices shall describe in reasonable detail the nature of the claim, action or proceeding and the Lessee's proposed response thereto. In addition, the Lessee shall provide to the Lessor, within sixty (60) Business Days of receipt, copies of all written communications with any Governmental Authority relating to any Environmental Law or any Release in connection with the Property. The Lessee shall also promptly provide such detailed reports of any such environmental claims as may reasonably be requested by the Lessor. In the event that the Lessor receives written notice of any pending or threatened claim, action or proceeding involving any Environmental Violation on or in connection with the Property, the Lessor shall promptly give notice thereof to the Lessee.

In the event that the Lessor receives written notice of any pending or threatened claim, action or proceeding involving any Environmental Violation Laws or any Release on or in connection with the Property, the Lessor shall promptly give notice thereof to the Lessee.. ARTICLE XV

In the event that the Lessor receives written notice of any pending or threatened claim, action or proceeding involving any Environmental Violation Hazardous Materials Laws or any Release on or in connection with the any Property, the Lessor shall promptly give notice thereof to the LesseeCompany.

Promptly, but in any event within sixty five (605) Business Days from the date the Lessor or Lessee has actual knowledge thereof, Lessor or Lessee, as the Lessee case may be, shall provide to the Lessor other written notice of any material pending or threatened claim, action or proceeding involving any Environmental Violation Law or any Release on or in connection with the Property. All such notices shall describe in reasonable detail the nature of the claim, action or proceeding and the Lessee's proposed response theretoproceeding. In addition, Lessor or Lessee, as the Lessee case may be, shall provide to the Lessorother, within sixty five (605) Business Days of receipt, copies of all material written communications with any Governmental Authority relating to any Environmental Law or any Release in connection with the Property. The Lessor and Lessee shall also promptly provide such detailed reports of any such material environmental claims as may reasonably be requested by the Lessorother or by the Bank. In the event that Failure by the Lessor receives written notice to provide any such notices to Lessee shall not affect any of any pending or threatened claimLessee's obligations under this Lease, action or proceeding involving including its obligation hereunder, if any, to remediate any Environmental Violation on or in connection with the Property, the Lessor shall promptly give notice thereof to the LesseeViolation.

In the event that the Lessor receives written notice of any pending or threatened claim, action or proceeding involving any Environmental Violation Laws or any Release on or in connection with the Propertyeither Site, the Lessor shall promptly give notice thereof to Lessee. For purposes of this paragraph, "Actual Knowledge" of Lessee shall mean the actual knowledge of Lessee's Director of Planning and Development, who is responsible for the day to day operations of the Sites.

All such notices shall describe in reasonable detail the nature of the claim, action or proceeding and the Lessee's ’s proposed response thereto.
