Common use of Notice of Fundamental Change Clause in Contracts

Notice of Fundamental Change. The Company shall send notices (each, a “Company Notice”) to the Holders (and to Beneficial Owners as required by applicable law) at their addresses shown in the Securities Register maintained by the Registrar, and delivered to the Trustee and Paying Agent, on or before the 20th calendar day after the occurrence of the Fundamental Change (each such date of delivery, a “Company Notice Date”). Each Company Notice shall include a form of Fundamental Change Purchase Notice to be completed by a Holder and shall state:

Notice of Fundamental Change. The Company shall send notices (each, a “Company Notice”) to the Holders (and to Beneficial Owners Holders, beneficial owners of the Securities as required by applicable law) at their addresses shown in the Securities Register maintained by the Registrar, and delivered to the Trustee and the Paying Agent, on or before the 20th calendar day 10th Business Day after the occurrence of the Fundamental Change Change, as the case may be (each such date of delivery, a “Company Notice Date”).
