Common use of Notice of Mortgage Clause in Contracts

Notice of Mortgage. 26.1 The Landlord hereby gives notice to the Tenant that possession of the Room might be recovered under Ground 2 of Schedule 2 of the Housing Xxx 0000 because 26.1.1 the Building is subject to a mortgage granted before the beginning of the tenancy; 26.1.2 the mortgagee is entitled to exercise a power of sale conferred on him by the mortgage or by section 101 of the Law of Property Xxx 0000; and 26.1.3 the mortgagee will require possession of the Room for the purpose of disposing of the Building with vacant possession if that power of sale is exercised.
