Common use of Notice of Third Party’s Infringement Clause in Contracts

Notice of Third Party’s Infringement. If a Party learns of substantial, credible evidence that a Third Party is infringing a Licensed Patent in the Field of Use in the Territory, that Party will promptly deliver written notice of the possible infringement to the other Party, describing in detail all relevant information to which that Party has access or control suggesting infringement of the Licensed Patent.

During the term of this Agreement only, the Company shall have a right to institute a suit against this and any other third party alleged to be infringing a Licensed Patent in the Field of Use as provided in the Territory, that Party will promptly deliver written notice of the possible infringement to the other Party, describing in detail all relevant information to which that Party has access or control suggesting infringement of the Licensed Patentsubsections 7.1.2 – 7.1.6.
