Common use of Notice of Voluntary Increases Clause in Contracts

Notice of Voluntary Increases. If the Board of Directors determines to increase the Conversion Rate pursuant to this ‎Section 5.07, then, at least fifteen (15) Business Days before such increase, the Company will send notice to each Holder, the Trustee and the Conversion Agent of such increase, the amount thereof and the period during which such increase will be in effect.

Notice of Voluntary Increases. If the Board of Directors determines to increase the Conversion Rate pursuant to this ‎Section 5.07Section 5.06, then, at least fifteen (15) Business Days before such increase, the Company will send notice to each Holder, the Trustee and the Conversion Agent of such increase, the amount thereof and the period during which such increase will be in effect. In the absence of such notice, the Trustee and the Conversion Agent may assume without inquiry that the Conversion Rate has not been adjusted and that the last Conversion Rate of which it has knowledge remains in effect.
