Common use of Notice to Funding Lender Clause in Contracts

Notice to Funding Lender. Borrower will promptly give Notice to Funding Lender upon the occurrence of any of the following events: (i) Borrower’s discovery of any Prohibited Activity or Condition. (ii) Borrower’s receipt of or knowledge of any written complaint, order, notice of violation or other communication from any tenant, Property Manager, Governmental Authority or other Person with regard to present or future alleged Prohibited Activities or Conditions, or any other environmental, health or safety matters affecting the Mortgaged Property. (iii) Borrower’s breach of any of its obligations under this Section 6.12. Any such Notice given by Borrower will not relieve Borrower of, or result in a waiver of, any obligation under this Continuing Covenant Agreement, the Project Note or any other Financing Document.
