Common use of Notice to Mortgagee and Ground Landlord Clause in Contracts

Notice to Mortgagee and Ground Landlord. Subsequent to the receipt by Tenant of notice from any person, firm or other entity that it is a Facility Mortgagee, or that it is the ground lessor under a lease with Landlord, as ground lessee, which includes the Leased Property as part of the demised premises, no notice from Tenant to Landlord shall be effective unless and until a copy of the same is given to such Facility Mortgagee or ground lessor and the curing of any of Landlord's defaults by such Facility Mortgagee or ground lessor shall be treated as performance by Landlord.
