Common use of Notices; Disbursement Clause in Contracts

Notices; Disbursement. Whenever the Borrower desires an Advance of the Swing Loans hereunder it shall give irrevocable notice to the Swing Loan Lender not later than 1:00 p.m. (New York time) on the date of the requested Advance by telephone, followed immediately by a confirmation of such request in writing in the form of Exhibit M hereto (a “Swing Loan Request”). Subject to satisfaction of the conditions set forth herein, the Swing Loan Lender shall initiate the transfer of funds representing such Advance to the Borrower by 3:00 p.m. (New York time) on the Business Day specified by the Borrower in the applicable Swing Loan Request.
