Notices; Failure to Notify. Within ninety (90) days after Evogene delivers a Collaboration Hit Data Backpack or a Collaboration Hit G2P Data Backpack containing a G2P Gene, Monsanto shall notify the Research Committee whether, to Monsanto’s knowledge based on its review of such Backpack and other relevant material, and in accordance with the same standards and criteria that Monsanto applies to Hits identified by Monsanto, the applicable Collaboration Hit or G2P Gene is subject to any of the issues set forth in Section 5.12.1, and if so, such notice shall include a description of the applicable issue or issues [* * *].
