NOTICES OF ENVIRONMENTAL BREACHES. (i) it has not received any summons, complaint, order or similar written notice that it is not in compliance with, or any public authority is investigating its compliance with, any Environmental Law or that it is or may be liable to any other person as a result of a potential or actual Discharge of a Hazardous Substance and (ii) none of its present or past operations is the subject of any investigation by any public authority evaluating whether any remedial action is needed to respond to a potential or actual Discharge of a Hazardous Substance;
