Common use of Notices of Exercise Clause in Contracts

Notices of Exercise. Concurrently with any exercise by the Collateral Agent of any of its rights and remedies under the Indenture Loan Documents following the occurrence of any default under the Indenture, the Notes, or the Indenture Loan Documents, the Collateral Agent shall give notice of such exercise to the Lender and shall only exercise such rights or remedies in a manner consistent with the terms of this Agreement. Concurrently with any exercise by the Lender of any of its rights and remedies under the Lender Loan Documents following the occurrence of any default under the Lender Loan Documents, the Lender shall give notice of such exercise to the Collateral Agent and shall only exercise such rights or remedies in a manner consistent with the terms of this Agreement.
