Common use of Notices of Issuance Clause in Contracts

Notices of Issuance. To request the issuance of a Letter of Credit (or any amendment, renewal or extension of an outstanding Letter of Credit), the Borrower shall give the Letter of Credit Issuer and the Administrative Agent irrevocable written notice at least three (3) Business Days prior to the requested date of such issuance specifying the date (which shall be a Business Day) such Letter of Credit is to be issued (or amended, renewed or extended, as the case may be), the expiration date of such Letter of Credit, the amount of such Letter of Credit, the name and address of the beneficiary thereof and such other information as shall be necessary to prepare, amend, renew or extend such Letter of Credit. In addition to the satisfaction of the conditions in Section 6, the issuance of such Letter of Credit (or any amendment which increases the amount of such Letter of Credit) will be subject to the further conditions that such Letter of Credit shall be in such form and contain such terms as the Letter of Credit Issuer shall approve and that the Borrower shall have executed and delivered any additional applications, agreements and instruments relating to such Letter of Credit as the Letter of Credit Issuer shall reasonably require; provided that in the event of any conflict between such applications, agreements or instruments and this Agreement, the terms of this Agreement shall control.

Notices of Issuance. To request Each Letter of Credit shall be issued upon notice, given not later than 1:00 P.M. (New York City time) three Business Days prior to the date of the proposed issuance of such Letter of Credit, by the Borrower to any Issuing Bank and the Administrative Agent, which shall give to each Lender prompt notice thereof by telex or telecopier. Each such notice of issuance of a Letter of Credit (a "Notice of Issuance") shall be by telex or any amendmenttelecopier, renewal or extension of an outstanding Letter of Credit)confirmed promptly in writing, the Borrower shall give the Letter of Credit Issuer and the Administrative Agent irrevocable written notice at least three specifying therein (3A) Business Days prior to the requested date of such issuance specifying the date (which shall be a Business Day), (B) the Available Amount requested for such Letter of Credit is Credit, (C) the identity of the Issuing Bank with respect to be issued such Letter of Credit, (or amended, renewed or extended, as the case may be), D) the expiration date of such Letter of Credit, (E) the amount of account party or parties for such Letter of Credit, (F) the name and address of the beneficiary thereof and such other information as shall be necessary to prepare, amend, renew or extend such Letter of Credit. In addition to the satisfaction of the conditions in Section 6, the issuance of such Letter of Credit and (or any amendment which increases G) the amount form of such Letter of Credit) will , together with a description of the nature of the transactions or obligations proposed to be subject to supported thereby. If the further conditions that requested form of such Letter of Credit shall be is acceptable to such Issuing Bank in its sole discretion, such form and contain such terms as Issuing Bank will, upon fulfillment of the Letter of Credit Issuer shall approve and that the Borrower shall have executed and delivered any additional applicationsapplicable conditions set forth in Article III, agreements and instruments relating to make such Letter of Credit available to the Borrower at its office referred to in Section 10.02 or as otherwise agreed with the Letter of Credit Issuer shall reasonably require; provided that Borrower in the event of any conflict between connection with such applications, agreements or instruments and this Agreement, the terms of this Agreement shall controlissuance.
