Notices Regarding Environmental Events. If at any time prior to the repayment in full of the Obligations (First Mezzanine), a Governmental Authority having jurisdiction over the Property requires, in writing, remedial action to correct the presence of Hazardous Materials in, around, or under the Property (an “Environmental Event”), Mezzanine Borrower shall or shall cause Mortgage Borrower to deliver prompt notice of the occurrence of such Environmental Event to Mezzanine Lender. Within thirty (30) days after Mezzanine Borrower or Mortgage Borrower has knowledge of the occurrence of an Environmental Event, Mezzanine Borrower shall or shall cause Mortgage Borrower to deliver to Mezzanine Lender an Officer’s Certificate (an “Environmental Certificate”) explaining the Environmental Event in reasonable detail and setting forth the proposed remedial action, if any.
