Common use of Notification of Owners Clause in Contracts

Notification of Owners. Promptly after becoming aware of any utility, owner of underground facilities and owner of property (excluding OPG and its subsidiaries) on, under, over or near the Site that may be affected by the Work, the Contractor will deliver a notice to OPG’s Representative as setting out how each such utility or owner may be affected and the identity of any such affected person. At OPG’s direction, the Contractor will address or co-operate with OPG in addressing all issues respecting the performance of the Work, including the protection, removal, relocation or replacement of the property of any such person. If applicable, the Contractor will comply with s. 228 of the Construction Projects regulation (O. Reg. 213/91) under the Occupational Health and Safety Act (Ontario).
