Common use of Novartis’ Right to Terminate Clause in Contracts

Novartis’ Right to Terminate. If Novartis has reason to believe that Akcea is in material breach of this Agreement (other than with respect to a failure to use Commercially Reasonable Efforts under ARTICLE 1, which is governed by Section 11.2.3 below), then Novartis may deliver notice of such material breach to Akcea.
