Common use of Nuclear Activity Restrictions Clause in Contracts

Nuclear Activity Restrictions. The Liquefaction Train System sold hereunder is not intended for application (and shall not be used) in connection with any nuclear installation or activity and Buyer warrants that it shall not use the Liquefaction Train System for such purposes, or permit others to use or permit others to use the Liquefaction Train System for any such purposes. If, in breach of the foregoing, any such use of the Liquefaction Train System sold hereunder occurs, Seller shall have no liability for any nuclear or other damage, injury or contamination, and Buyer shall indemnify Seller, its Affiliates and suppliers of every type and tier against any such liability, whether arising as a result of breach of contract, warranty, indemnity, tort (including negligence), strict liability or otherwise.
