The Nuclear Incident clause defines how liabilities and responsibilities are managed in the event of a nuclear-related accident or incident. Nuclear Incident. WE DO NOT INSURE claims arising out of any event which is insured under a nuclear energy liability policy issued by the Nuclear Insurance Association of Canada or any other group or pool of insurers, regardless of exhaustion of such policy limits or its termination. This exclusion applies whether or not there is another cause or occurrence (whether covered or not) that contributes concurrently or in any sequence to the occasioning of the loss or damage.
Nuclear Incident. (a) WE DO NOT INSURE loss, damage or expenses caused directly or indirectly by any nuclear accident as defined in any nuclear liability act, law or statute, or by nuclear explosion.
(b) WE DO NOT INSURE loss or damage caused by contamination by radioactive material. These exclusions apply whether or not there is another cause or occurrence (whether covered or not) that contributes concurrently or in any sequence to the occasioning of the loss, damage or expenses.

This provision excludes any liability arising from any Claim resulting or arising, directly or indirectly, from any nuclear material handling, usage, processing, storage, transportation, or disposal, or any nuclear facility ownership or operation, by or on behalf of the Fund Member.
