Common use of NYSE Listing of Shares Clause in Contracts

NYSE Listing of Shares. To the extent it has not already done so, the Company shall promptly apply to cause the shares of Common Stock issuable upon the conversion of the Private Placement Preferred Shares to be approved for listing on the NYSE, subject to official notice of issuance.
