Oath and Bond Clause Samples

The Oath and Bond clause requires an individual, often someone appointed to a fiduciary role such as an executor or trustee, to formally swear to faithfully perform their duties and to provide a financial guarantee (bond) as security for their proper conduct. In practice, this means the person must take an official oath before a court or authorized official and may need to obtain a surety bond, which protects beneficiaries or interested parties against potential misconduct or mismanagement. This clause ensures accountability and provides a safeguard against losses caused by the fiduciary's failure to fulfill their obligations.
