Common use of Obligation of Depositary Clause in Contracts

Obligation of Depositary. The Company and the Depositary agree that in the event the Depositary does not receive any of (i) the Notice, (ii) the Admission Request or (iii) the Voting Instruction Card on or prior to the date specified therefore in this Section 4.10, the Depositary shall have no obligation to distribute or forward, as the case may be, such notice or instruction card or prepare the applicable confirmation of beneficial ownership.
