Obligation to Maintain as Confidential. Each Party acknowledges that in the course of the performance of this Agreement it may have access to information that the other Party considers proprietary ("Proprietary Information"). Propriety Information shall be marked as proprietary with an appropriate legend, marking, stamp or other obvious written identification prior to disclosure. All Proprietary Information in tangible form of expression which has been delivered (or thereafter created by copy or reproduction pursuant to this Agreement) shall be and remain the property of the person which is disclosing such Proprietary Information (the "Disclosing Party").
