Common use of Obligation to Mitigate Clause in Contracts

Obligation to Mitigate. The Affected Party must: (a) keep the other Party fully informed of its plans to minimise the effect of the Force Majeure Event; and (b) subject to reaching agreement concerning any modifications or additions required to give effect to any proposal to minimise the effect of the Force Majeure Event: (i) comply with all reasonable requests made by the other Party relating to the prevention or minimisation of the impact of the Force Majeure Event; and (ii) use all reasonable endeavours to resolve, and minimise the impact of, the Force Majeure Event.

The the Affected Party must: (a) 28.5.1 keep the other Party fully informed of its plans plan to minimise the effect of the Force Majeure Event; and; (b) 28.5.2 subject to reaching agreement concerning any modifications or additions addition required to give effect to any proposal to minimise the effect of the Force Majeure Event:; (ia) comply with all reasonable requests made by the other Party relating to the prevention or minimisation of the impact of the Force Majeure Event; and (iib) use all reasonable endeavours to resolve, and minimise the impact of, the Force Majeure Event.

The the Affected Party must: (a) 27.5.1 keep the other Party fully informed of its plans plan to minimise the effect of the Force Majeure Event; and (b) 27.5.2 subject to reaching an agreement concerning any modifications or additions addition required to give effect to any proposal to minimise the effect of the Force Majeure Event: (ia) comply with all reasonable requests made by the other Party relating to the prevention or minimisation of the impact of the Force Majeure Event; and (iib) use all reasonable endeavours to resolve, and minimise the impact of, the Force Majeure Event.

The Affected Party must: (a) 14.5.1 keep the other Party fully informed of its plans plan to minimise the effect of the Force Majeure Event; and (b) 14.5.2 subject to reaching agreement concerning any modifications or additions addition required to give effect to any proposal to minimise the effect of the Force Majeure Event:; (i) 14.5.3 comply with all reasonable requests made by the other Party relating to the prevention or minimisation of the impact of the Force Majeure Event; and (ii) 14.5.4 use all reasonable endeavours to resolve, and minimise the impact of, the Force Majeure Event.

Obligation to Mitigate. The Affected Party must: (a) 16.5.1 keep the other Party fully informed of its plans plan to minimise the effect of the Force Majeure Event; and (b) 16.5.2 subject to reaching agreement concerning any modifications or additions addition required to give effect to any proposal to minimise the effect of the Force Majeure Event:; (i) 16.5.3 comply with all reasonable requests made by the other Party relating to the prevention or minimisation of the impact of the Force Majeure Event; and (ii) 16.5.4 use all reasonable endeavours to resolve, and minimise the impact of, the Force Majeure Event.
