Obligation to Repurchase Surplus Provisioning Items. During a period commencing one (1) year after the Delivery Date of the first Aircraft, and ending five (5) years after such Delivery Date, XXXX shall, upon receipt of Buyer's written request and subject to the exceptions in Annex A Article 2.8.4, repurchase unused and undamaged Provisioning Items which: (i) were recommended by XXXX as initial provisioning for the Aircraft, (ii) were purchased by Buyer from XXXX, and (iii) are surplus to Buyer's needs.
