OBLIGATIONS AND COVENANTS OF THE PARTNERSHIP. (a) From the date of this Agreement to the Closing Date, the Partnership shall: (1) Maintain, manage and operate the Property in substantially the same condition and manner as such Property is now maintained, managed and operated by the Partnership, and keep the Property, including, without limitation, the Improvements and Personal Property, in substantially the same good condition and repair as such Property is now maintained, ordinary wear and tear excepted; (2) Maintain the Existing Loan in full force and effect, timely make all payments, and observe and perform in all material respects all covenants to be paid, observed or performed by the mortgagor thereunder, and promptly deliver to the Home Properties any notice of default received thereunder;
