Common use of Obligations of Respondent Clause in Contracts

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021, Respondent agrees to pay the sum of $439,620 (four hundred and thirty-nine thousand, six hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the Notices, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, and to abide by the terms of the Notices of Noncompliance Determination, issued on April 28, 2020, and captioned under case numbers 2018-SE-43029 and 2018-SE-43031.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 890,000 (four eight hundred and thirty-nine thousand, six hundred and twenty ninety thousand dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States Xxxxx+Xxxxx brand basic models XXXX-090D and XXXX-120C, model D56 1/2S4C-C and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28September 2, 2020, 2021 and captioned under case numbers 2018number 2019-SE-43029 and 2018-SE-43031SE-64001.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 6,612 (four hundred and thirty-nine six thousand, six hundred and twenty twelve dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, model Q7RF-X24K and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28March 26, 2020, and captioned under case numbers 2018-SE-43029 and 2018-SE-43031number 2020- SE-16009.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 8,400 (eight thousand four hundred and thirty-nine thousand, six hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States the basic models XXXX-090D and XXXX-120C, model associated with outdoor model UPNL-024JAZ and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April March 28, 20202019, and captioned under case numbers 2018number 2015-SE-43029 and 2018-SE-43031SE-16027.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 7,252 (four seven thousand, two hundred and thirtyfifty-nine thousand, six hundred and twenty two dollars) as full satisfaction Case No. 2018-SE-42005 Page 2 of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28January 23, 20202019, and captioned under case numbers number 2018-SE-43029 and 2018-SE-43031SE- 42005.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 10,136 (four hundred and ten thousand, one hundred, thirty-nine thousand, six hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28July 31, 20202018, and captioned under case numbers number 2018-SE-43029 and 2018-SE-43031SE- 65002.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 328,500 (four three hundred and thirtytwenty-nine eight thousand, six five hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic the subject models XXXX-090D and XXXX-120C, and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 2820, 2020, and captioned under case numbers number 2018-SE-43029 and 2018-SE-43031SE-43006.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 13,705 (four thirteen thousand, seven hundred and thirty-nine thousand, six hundred and twenty five dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees to not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120Cmodel VHC60, and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28May 8, 20202019, and captioned under case numbers 2018number 2016-SE-43029 and 2018-SE-43031SE-43010.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 81,149 (four eighty-one thousand, one hundred and thirtyforty-nine thousand, six hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute cease permanently distributing in commerce in the United States basic models XXXX-090D and XXXX-120Cmodel 80A, and to otherwise abide by the terms of the Notices Notice of Noncompliance Determination, Determination issued on April 28June 13, 20202019, and captioned under case numbers 2018number 2015-SE-43029 and 2018-SE-43031SE-44010.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2, 2021within thirty (30) calendar days after the date of the Notice, Respondent agrees to pay the sum of $439,620 687,000 (four hundred and thirty-nine thousand, six hundred and twenty eighty-seven thousand dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, model G75-75N and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28May 20, 20202019, and captioned under case numbers 2018number 2016-SE-43029 and 2018-SE-43031SE-44004.

Obligations of Respondent. a. If Respondent executes this Compromise Agreement and returns it to DOE by June 2April 15, 20212022, Respondent agrees to pay the sum of $439,620 587,500 (four five hundred and thirty-nine thousand, six eighty- seven thousand five hundred and twenty dollars) as full satisfaction of the civil penalty proposed in the NoticesNotice, within thirty (30) calendar days of the issuance of an Adopting Order. b. Respondent agrees not to distribute in commerce in the United States basic models XXXX-090D and XXXX-120C, model KCB092S4B**Y,G,J and to abide by the terms of the Notices Notice of Noncompliance Determination, issued on April 28December 29, 20202021, and captioned under case numbers 2018number 2020-SE-43029 and 2018-SE-43031SE-43005.

Obligations of Respondent. a.
