Common use of Obligations of the Concessionaire during Implementation Period Clause in Contracts

Obligations of the Concessionaire during Implementation Period. (a) The Concessionaire shall, before commencement of construction of the Project; (i) submit to the Independent Consultant with due regard to Project Completion Schedule and Scheduled Project Completion Date, its engineering and construction time schedule, Critical Path Method (CPM)/ Project Evaluation and Review Technique (PERT) charts for the completion of the said activities; (ii) have requisite organisation and designate and appoint suitable officers/ representatives as it may deem appropriate to supervise the Project and to deal with the Independent Consultant/ the Monitoring Committee and to be responsible for all necessary exchange of information required pursuant to this Agreement; (iii) undertake, do and perform all such acts, deeds and things as may be necessary or required to adhere to the Project Completion Schedule and to achieve Project Completion under and in accordance with this Agreement; (iv) construct, provide and maintain a furnished site office accomodation for the Independent Consultant at the Project Site; and (v) provide and maintain an adequately equipped field laboratory as required for the Project Site control on the quality of materials and the Construction Works. (b) The Concessionaire shall, at all times, afford access to the Project Site, to the Monitoring Committee, the authorised representatives of NGS, SMC, the Independent Consultant and officer of any Government Agency having jurisdiction over the Project, including those concerned with safety, security or environmental protection to inspect the Project and to investigate any matter within their authority and upon reasonable notice, the Concessionaire shall provide to such persons reasonable assistance necessary to carry out their respective duties and functions. (c) The Concessionaire shall be responsible for ensuring that any existing utility on, under or above the Project Site is kept in continuous satisfactory use, if necessary, by the use of suitable temporary or permanent diversions. (d) The Concessionaire shall bear all costs and charges for special or temporary rights of way required by it in connection with access to the Project Site. The Concessionaire shall obtain at its cost such facilities on or outside the Project Site as may be required by it for the purposes of the Project and the performance of its obligations under this Agreement .

(a) The Concessionaire shall, before commencement of construction implementation of the Project; (i) submit to the Independent Consultant Nodal Officer with due regard to Project Completion Schedule and Scheduled Project Completion Date, its engineering and construction time schedule, Critical Path Method (CPM)/ Project Evaluation and Review Technique (PERT) charts for the completion of the said activities; (ii) have requisite organisation organization and designate and appoint suitable officers/ representatives as it may deem appropriate to supervise the Project and to deal liaison with the Independent Consultant/ the Monitoring Committee Nodal Officer and to be responsible for all necessary exchange of information required pursuant to this Agreement; (iii) undertake, do and perform all such acts, deeds and things as may be necessary or required to adhere to the Project Completion Schedule and to achieve Project Completion under and in accordance with this Agreement; (iv) construct, provide and maintain a furnished site office accomodation for the Independent Consultant at the Project Site; and (v) provide and maintain an adequately equipped field laboratory as required for the Project Site control on the quality of materials and the Construction Works. (b) The Concessionaire shall, at all times, afford access to the Project Site, to the Monitoring Committee, the authorised representatives of NGS, SMC, the Independent Consultant BSCDCL and officer of any Government Agency having jurisdiction over the Project, including those concerned with safety, security or environmental protection protection, to inspect the Project and to investigate any matter within their authority and upon reasonable notice, the Concessionaire shall provide to such persons reasonable assistance necessary to carry out their respective duties and functions. (c) The Concessionaire shall be responsible apply for ensuring that any existing utility on, under and obtain all necessary clearances and/ or above approvals for the Project Site is kept in continuous satisfactory use, if necessary, by the use of suitable temporary or permanent diversions. (d) project implementation. The Concessionaire shall bear all costs and charges for special or temporary rights of way sites required by it in connection with access to the Project Site. The Concessionaire shall obtain at its cost such facilities on or outside the Project Site as may be required by it for the purposes of the Project and the performance of its obligations under this Agreement Agreement. (d) In case of loss due to theft or damage to the assets created at the project site, the Concessionaire shall be responsible for making good the same immediately at its own cost and shall continue to keep the project sites operational and available for public use, at all times, within the Concession Period.

(a) The Concessionaire shall, before commencement of construction of the Project; (i) submit to the Independent Consultant Engineer with due regard to Project Completion Schedule and Scheduled Project Completion Date, its engineering and construction time schedule, Critical Path Method (CPM)/ Project Evaluation and Review Technique (PERT) charts for the completion of the said activities; (ii) have requisite organisation organization and designate and appoint suitable officers/ representatives as it may deem appropriate to supervise the Project and to deal liaison with the Independent Consultant/ the Monitoring Committee Engineer and to be responsible for all necessary exchange of information required pursuant to this Agreement; (iii) undertake, do and perform all such acts, deeds and things as may be necessary or required to adhere to the Project Completion Schedule and to achieve Project Completion under and in accordance with this Agreement; (iv) construct, provide and maintain a furnished site office accomodation for the Independent Consultant at the Project Site; and (v) provide and maintain an adequately equipped field laboratory as required for the Project Site control on the quality of materials and the Construction Works. (d) In case of loss due to theft or damage to the assets created in the BusShelters, the Concessionaire shall be responsible for making good the same immediately at its own cost and shall continue to keep the Bus Shelters operational and available for public use, at all times, within the Concession Period.

Obligations of the Concessionaire during Implementation Period. (a) The Concessionaire shall, before commencement of construction of the ProjectProject Facility and Project Uplift; (i) submit to the Independent Consultant DTIDCL Engineer/ DTIDCL with due regard to Project Completion Schedule and Scheduled Project Completion Date, its engineering design and construction up-gradation time schedule, Critical Path Method (CPM)/ Project Evaluation and Review Technique (PERT) charts for the completion of the said activities; (ii) have requisite organisation organization and designate and appoint suitable officers/ representatives as it may deem appropriate to supervise the Project and to deal with the Independent Consultant/ the Monitoring Committee DTIDCL Engineer/ Steering Group and to be responsible for all necessary exchange of information required pursuant to this Agreement; (iii) undertake, do and perform all such acts, deeds and things as may be necessary or required to adhere to the Project Completion Schedule and to achieve Project Completion under and in accordance with this Agreement; (iv) construct, provide and maintain a furnished site office accomodation for the Independent Consultant at the Project Site; and (v) provide and maintain an adequately equipped field laboratory as required for the Project Site control on the quality of materials and the Construction Works. (b) The Concessionaire shall, at all times, afford access to the Project SiteSites, to the Monitoring CommitteeDTIDCL Engineer, the authorised representatives of NGS, SMC, the Independent Consultant DTIDCL and officer of any Government Agency having jurisdiction over the Project, including those concerned with safety, security or environmental protection protection, to inspect the Project and to investigate any matter within their authority and upon reasonable notice, the Concessionaire shall provide to such persons reasonable assistance necessary to carry out their respective duties and functions. (c) The Concessionaire shall be responsible for ensuring that any existing utility on, under or above the Project Site is kept in continuous satisfactory use, if necessary, by the use of suitable temporary or permanent diversions. (d) The Concessionaire shall bear all costs and charges for special or temporary rights of way sites required by it in connection with access to the Project SiteSites. The Concessionaire shall obtain at its cost such facilities on or outside the Project Site Sites as may be required by it for the purposes of the Project and the performance of its obligations under this Agreement. d) In case of loss due to theft or damage to the assets created in the Bus Shelters, the Concessionaire shall be responsible for making good the same immediately at its own cost and shall continue to keep the Bus Shelters operational and available for public use, at all times, within the Agreement Period.
