Common use of Obligations preserved Clause in Contracts

Obligations preserved. Where disclosure is permitted under Clause 40.2 (other than Clauses 40.2.2, 40.2.3 and 40.2.5 and 40.2.7) the Party providing the information shall procure that the recipient of the information shall be subject to the same obligation of confidentiality as that contained in this Agreement.

Where disclosure is permitted under Clause 40.2 clause 55.2 (Permitted Disclosure), other than Clauses 40.2.2clauses 55.2.2, 40.2.3 55.2.4, 55.2.5, 55.2.8 and 40.2.5 and 40.2.7) 55.2.10, the Party party providing the information shall procure that the recipient of the information shall be subject to the same obligation of confidentiality as that contained in this Agreement.

Where disclosure is permitted under Clause 40.2 clause 49.2 (other than Clauses 40.2.2clauses 49.2.2, 40.2.3 49.2.4, 49.2.5, 49.2.8 and 40.2.5 and 40.2.749.2.9) the Party providing the information shall procure that the recipient of the information shall be subject to the same obligation of confidentiality as that contained in this Agreement.

Where disclosure is permitted under Clause 40.2 clause 69.2 (Permitted Disclosure) (other than Clauses 40.2.2clauses 69.2(b), 40.2.3 69.2(d), 69.2(e), 69.2(h) and 40.2.5 and 40.2.769.2(j)) the Party party providing the information shall use reasonable endeavours to procure that the recipient of the information shall be subject to the same obligation of confidentiality as that contained in this AgreementContract.

Where disclosure is permitted under Clause 40.2 (59.2 other than Clauses 40.2.259.2.2, 40.2.3 59.2.4, 59.2.5, 59.2.8 and 40.2.5 and 40.2.7) 59.2.10 the Party party providing the information shall procure that the recipient of the information shall be subject to the same obligation of confidentiality as that contained in this Agreement.
