Obligations to Construct Facilities. The parties acknowledge that redeveloping the Waterfront District in conformance with the Sub-Area Plan will require Facilities. The Port’s and City’s obligations for providing such Facilities and the phasing of such Facilities are set forth below. The obligation to construct a Facility pursuant to this Agreement is conditioned on the parties’ receipt of all necessary permits and approvals. Except as set forth herein or as otherwise agreed by the Port and the City, all other infrastructure on development parcels is the responsibility of the Developer, who shall comply with the provisions of BMC 20.37.460.

1.1 Projects Completed or Underway. Since the 2013 Agreement several projects have been started or completed. For clarity, this Agreement will note the status of projects where applicable.
