Obligations upon Start Date. (a) Either Party’s obligations under this Agreement shall be conditional upon satisfaction of (i) Conditions Precedent to this Agreement and (ii) conditions prescribed for each CT Agreement.
(b) The relevant date for commencement of delivery of Gas at the Delivery Point and offtake of Gas at the Redelivery Point and liability for Transmission Charges, Shortfall Quantities and any Liquidated Damages under this Agreement shall be the relevant CT Start Date under this Agreement.
(c) If on the CT Start Date and thereafter on any such Day, Transporter is able to take deliveries of the Gas quantities up to the CT Delivery Point MDQ at the Delivery point and allow the off-take of Gas quantities up to the CT Redelivery Point MDQ at the Redelivery Point and the Shipper is unable to deliver Gas to the Transporter at the Delivery Point and/ or has not commenced off-takes of Gas at such Redelivery Points then the Shipper shall still be required to pay the applicable Transmission Charges.
(d) If on the CT Start Date and thereafter on any such Day, ▇▇▇▇▇▇▇ is able to make deliveries of the Gas quantities up to the CT Delivery Point MDQ at the Delivery Point and off-take Gas quantities up to the CT Redelivery Point MDQ at the Redelivery Point and the Transporter is unable to accept delivery of such Gas at the Delivery Point or deliver such Gas to the Redelivery Point then Clauses 7.2 and 7.3 shall apply.
Obligations upon Start Date. (a) Either Party’s obligations under GTA shall be conditional upon satisfaction of clause 2 of GTA.
(b) The relevant date for commencement of delivery of Gas at the Entry Point and offtake of Gas at the Exit Point and liability for Transportation Tariff and Transportation Charges under GTA, Shortfall Quantities and any Liquidated Damages under GTA shall be the relevant Start Date under CT Agreement.
(c) If on the Start Date as mentioned in CT Agreement and thereafter on any such Day, Transporter is able to take deliveries of the Gas quantities up to the Entry Point MDQ at the Entry Point and allow the off-take of Gas quantities up to the Exit Point MDQ at the Exit Point and the Shipper is unable to deliver Gas to the Transporter at the Entry Point and/ or has not commenced off-takes of Gas at such Exit Points then the Shipper shall still be required to pay the applicable Transportation Tariff and Transportation Charges, as applicable under the present GTA.
(d) If on the Start Date and thereafter on any such Day as agreed in the CT Agreement, Shipper is able to make deliveries of the Gas quantities up to the Entry Point MDQ at the Entry Point and off-take Gas quantities up to the Exit Point MDQ at the Exit Point and the Transporter is unable to accept delivery of such Gas at the Entry Point or deliver such Gas to the Exit Point then clauses 6.2 and 6.3 shall apply.
