Common use of OFAC Restrictions Clause in Contracts

OFAC Restrictions. Neither the Borrower nor any Project Company, nor, to the Borrower’s knowledge, any Person holding any legal or beneficial interest whatsoever in the Borrower or any Project Company (whether directly or indirectly): (i) appear on the OFAC SDN List; (ii) are included in, owned by, controlled by, acting for or on behalf of, providing assistance, support, sponsorship, or services of any kind to, or otherwise associated with any of the Persons referred to or described in the OFAC SDN List; or (iii) have conducted business with or engaged in any transaction with any Person named on any of the OFAC SDN List or any Person included in, owned by, controlled by, acting for or on behalf of, providing assistance, support, sponsorship, or services of any kind to, or otherwise associated with any of the Persons referred to or described in the OFAC SDN List.
