Common use of OMPA Payment of Subcontractors Clause in Contracts

OMPA Payment of Subcontractors. OMPA has no obligation to pay Subcontractors or ensure that the Subcontractors are properly paid by Contractor. If OMPA determines that a Subcontractor has not received payment for its portion of the work, then OMPA may, at OMPA's sole discretion, directly pay the Subcontractor the amount that it is owed and may deduct that amount from any future payment to Contractor or issue a separate invoice to Contractor for the amount paid to the subcontractor, plus a reasonable administrative fee.
