Common use of Operating Cash Flow Clause in Contracts

Operating Cash Flow. Except as provided elsewhere in this Agreement, Operating Cash Flow of the Partnership shall be distributed to the Partners monthly, so long as the General Partner determines it is available for distribution, in the following order of priority: (a) First, to the Limited Partners in proportion to their unpaid cumulative, non-compounded Preferred Returns until all unpaid Preferred Returns have been paid in accordance with their Percentage Interests until all Limited Partners have received a cumulative, non-compounded Preferred Return of six percent (6%) per annum on their Capital Contributions. (b) Second, sixty-five percent (65%) to the Limited Partners in proportion to their respective Percentage Interests, and thirty-five percent (35%) to the General Partner.
