Operating Charges. Tenant shall pay to Landlord, as additional rent, Tenant’s Proportionate Share of Operating Charges as defined below. Estimated amounts of such additional rent shall be paid in monthly installments in advance on the first day of each month during the Term. The initial estimated payment of Tenant’s Proportionate Share of Operating Charges is set forth in Section 1.9. From time to time during the Term, Landlord may notify Tenant in writing of any adjustment to the monthly installments to be paid by Tenant hereunder and thereafter Tenant shall make payments accordingly. Within sixty (60) days after the expiration of each calendar year or as soon thereafter as is reasonably practicable (but not later than 90 days after the expiration of each calendar year), Landlord shall notify Tenant of the actual Operating Charges for such calendar year and provide Tenant a written statement thereof in reasonable detail. Within thirty (30) days after such notice, Tenant shall pay to Landlord or Landlord shall credit against the obligations of Tenant, as the case may be, the difference between the estimated payments made by Tenant during the prior calendar year and the actual amount of Tenant’s Proportionate Share of Operating Charges as shown on such statement. Tenant’s Proportionate Share of Operating Charges for the years in which the Term commences and ends shall be prorated based upon the number of days of the Term during such years. Tenant’s obligation for Tenant’s Proportionate Share of Operating Charges through the Termination Date shall survive termination.
Operating Charges. In addition to the Rent, the Lessee shall during the Term regularly and punctually bear and pay all charges for electricity and water consumed by the Lessee in the Unit in accordance with the electricity bills and water bills issued in respect thereof for which a separate meter is installed in the Unit by the Lessor.
Operating Charges all expenses, charges and fees incurred by or on behalf of Landlord in connection with the management, operation, ownership, maintenance, servicing, insuring and repair of the Building (which is deemed to include the site upon which the Building is constructed (which site is sometimes referred to herein as the “Land”), the roof of the Building and any physical extensions therefrom, any driveways, sidewalks, landscaping and parking facilities in the Building or on the Land, and all other areas, facilities, improvements and appurtenances relating to any of the foregoing) including the following: (1) electricity with respect to the Common Areas and the Building systems (as reasonably determined by Landlord), gas, water, HVAC (including chilled condenser water), sewer and other utility and service costs, charges and fees (including any tap fees and connection and switching fees) of every type and nature; (2) premiums, deductibles and other charges for insurance; (3) management fees of not more than three percent (3%) of the adjusted gross revenues of the Building (plus amounts that would have been received had there been no rental abatements or other concessions); (4) costs of service, equipment rental, access control, landscaping and maintenance contracts; (5) maintenance, repair and (subject to the limitations on capital expenditures set forth below) replacement expenses and supplies; (6) depreciation/amortization for capital expenditures made by Landlord to reduce operating expenses or to comply with Laws imposed after the date hereof, which shall be charged in annual installments over the useful life of the items for which such costs are incurred (provided that in the case of capital expenditures reasonably estimated to reduce operating expenses, Landlord shall have the right to amortize such expenses in annual installments equal to the projected annual savings) together with interest, each calendar year such costs are charged to Operating Charges, on the unamortized balance at an interest rate of two percent (2%) in excess of the Prime Rate in effect on January 1 of each calendar year; (7) charges for janitorial and cleaning services and supplies; (8) any business, professional or occupational license tax payable by Landlord with respect to the Building and any association fees; (9) [reserved]; (10) sales, use and personal property taxes payable in connection with tangible personal property and services purchased for and used in connection with the Buildi...
Operating Charges as used herein shall further be defined as the total cost to LESSOR of complying with LESSOR'S obligations under Article 24(a), (b), and (c) hereof (entitled Common Areas Maintenance, Operation, Insurance and Taxes by LESSOR). Any increase in the costs otherwise includable in OPERATING CHARGES which are directly attributable to a Strip Center tenant's wilful action or negligence, change of use in a unit within Strip Center or alterations, additions, and/or improvements to a unit within Strip Center shall be excluded from OPERATING CHARGES computations.
Operating Charges. Tenant shall pay, as additional Rent, the Property's Operating Charges. "Operating Charges" shall mean the expenses reasonably incurred by Landlord or Tenant in the ownership and operation of the Property, such as: gas, water, sewer, electricity and other utility charges, premiums and other charges for insurance; maintenance and repair of the Property; property taxes; groundskeeping; landscaping; snow removal; Common Area fees and any Association Fees; and HVAC. Operating Charges shall not include expenses of a capital nature, including, but not limited to, capital improvements, capital repairs, capital equipment, and capital tools which, under generally accepted accounting principles, are not regarded as operating or maintenance expenses, such as: roof, outside walls, foundation, and structural portions of the Property, and the exterior of the building on the Property ("Building"). If the exact amounts of Operating Charges are not available at the expiration of the Lease, and if, in Landlord's reasonable estimation, Tenant's estimated payments have not been sufficient to cover Tenant's actual Operating Charges then the balance shall be due and payable concurrently with the final installment of Base Rent due hereunder, or, at Landlord's option, such payment shall be postponed until such amounts are determined. Tenant's obligation to make such payments shall survive the expiration or termination of this Lease.
Operating Charges i) The Shipper shall pay to the Transporter an Operating Charges @2.5% of Connectivity Charges including subsequent Connectivity Charges with 5% escalation on annual basis. The Operating Charges shall be collected in advance with applicable taxes.
ii) The escalation of 5% per annum shall be reckoned from the beginning of the next Financial Year on yearly rest basis.
iii) The Transporter shall raise the invoice for the Operating Charges within fifteen (15) days of commissioning date as per clause 4.1 above on pro rata basis for the period remaining in such Financial Year and then onwards in advance on annual basis within 15 days from the beginning of new Financial Year and the Shipper shall pay the invoice amount within four (4) working days of receipt of the invoice from the Transporter. Any delay in making such payment shall attract “Interest”, which shall be payable by the Shipper.
Operating Charges. For the period commencing with the Sixth Amendment Expansion Effective Date and ending on the Termination Date, Tenant shall pay for its Proportionate Share of the Operating Charges applicable to the Sixth Amendment Expansion Space in accordance with the terms of the Lease, provided, however, during such period, the Operating Charges Base Year for the computation of Tenant’s Proportionate Share of Operating Charges applicable to the Sixth Amendment Expansion Space is 2000.
Operating Charges. For the period commencing on the Extension Date and ending in the Extended Termination Date, Tenant shall pay for its proportionate share of Operating Charges in accordance with the terms of the Lease, provided, however, during such period; the Operating Charges Base Year for the computation of Tenant’s proportionate share of Operating Charges shall be calendar year 2001.
Operating Charges. As used herein, "Tenant's Share" shall be equal to seventeen and 1/4 percent (17.25%) which is the ratio of the total area of the Premises including any mezzanines (nine thousand six hundred twenty-eight (9,628) square feet), to the total rentable area of the Building (fifty-five thousand eight hundred seven (55,807) square feet). In addition to the Base Rent provided for hereunder, and commencing at the same time as Base Rent commences under this Lease, Tenant shall pay as additional rent to Landlord Tenant's Share of the following items, herein called "Operating Charges":
Operating Charges. Tenant shall pay proratta share of operating charges associated with the building. The definition of the charges can be found in section 5.2. The current charge, due monthly, is $1.40 per s.f. or $770.00 per month
