Operational Conditions. Territory: Merchant must be located in Credorax's licensed area of use which comprises the following: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, France, Finland, Germany, Gibraltar, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, Netherlands, United Kingdom. Unless otherwise agreed, the Merchant agrees to accept, from Merchant's location, Cards as payment for its goods and/or services supplied within the normal range of its activity and without discriminating any Cards. Merchant shall ensure that the Merchant's location shall meet the requirements as set under the Card Scheme Rules.
Operational Conditions. This Contract of Use and the use by Railway Undertaking of the Main Railway Network and the Service Facilities falling within the scope of this Contract of Use in accordance with article 2.1 and the services to be provided by Infrastructure Manager are subject to the Operational Conditions, without prejudice to the provisions of or pursuant to the Spoorwegwet.

Operational Conditions i. Each party has a license from the regulatory board and shall comply with the license conditions and laws that apply to it as to provision of services.
ii. Any amendments to this agreement shall also be first approved by the Regulatory Board before they are implemented.
Operational Conditions. These precedent conditions shall be satisfi ed within six (6) month of the Effective Date. In the event that these cannot be achieved the Parties will proceed as follows:
a) The parties shall meet and attempt an agreement on such extension as shall be fair and reasonable in the circumstances to allow such conditions to be satisfi ed.
b) In the event that no such agreement can be reached the parties shall call upon the a mediator to mediate.
c) Thereafter, if no agreement will be reached, the parties shall proceed to the Water Ap-peals Board.
Operational Conditions. The Operational Conditions apply to this Capacity Agreement as well as to the services to be provided thereby by Infrastructure Manager, without prejudice to the provisions under or pursuant to the Spoorwegwet.
Operational Conditions. 1. The Standby person will carry a City cell phone when away from his/her listed contact phone number.
2. The Standby person cannot engage in any activity that would impair judgment or prohibit a response while on Standby.
3. Calls to the Standby person will be placed by the Treatment Plant Operator.
a. Treatment Plant Operator will screen calls to determine need to contact Standby person.
b. Upon being contacted by the Treatment Plant Operator, the Standby person is responsible to determine the course of action.
c. Should the Standby person fail to respond to a call, (s)he forfeits Standby pay for that day.
d. The Treatment Plant Operator stands by to assist, when possible, in contacting additional employees when needed.
e. Should the Standby person need assistance, the Treatment Plant Operator will first attempt to call list members in sequential order. When the assistance requires specialized personnel, who are better qualified to perform a specific task, the Treatment Plant Operator may call back the first person(s) from the list qualified to perform the specific task.
f. Upon call completion, the Standby person will advise the Treatment Plant Operator of the action taken so that it can be properly logged.
4. During a serious emergency, such as a water main break, the Standby person will stand by to assist the crew in making repairs but will remain flexible in case of other call-outs during this time.
5. Employees who are assigned Xxxxxxx duty may request the use of a City truck, subject to department Director approval. The City truck shall be available to the employee during Standby for use as is necessary to ensure that the employee is readily available for call out. However, the employee should use discretion and common sense in the use of the vehicle and at all times be aware that they are a public relations representative to the public and their actions will be scrutinized by the public. Further, the employee must ensure any personal use is consistent with City policy.
Operational Conditions. 3.1. The Hirer must provide sufficient independent toilet facilities on the land to comply with the Environmental Health Officer’s and the Council’s requirements. All toilets must be kept clean at all times with ample supply of toilet rolls, soap and hand-drying facilities.
3.2. The Hirer must provide adequate levels of car parking throughout the event.
3.3. The Hirer must ensure that appropriate levels of stewarding are provided during the designated hours of the Hire Period. This includes stewarding for event safety, car parking and traffic management leading to (and within) the Park grounds.
3.4. The Hirer is responsible for the preservation of good order during the Hire Period. The Hirer shall ensure that there is proper care and supervision of young children.
3.5. The Hirer is responsible for notifying the emergency services of the Event and to arrange for medical cover to be available at all times during the event.
3.6. If any special equipment is required (including generators and inflatables), it must be clearly stated on the application form. The Council must be satisfied that a competent person will supervise the use of the equipment.
3.7. The Hirer will be responsible for health and safety of their visitors and will (if required) attend a Health and Safety Briefing with the Premises Officer prior to the event. The Hirer will be responsible for providing any first aid facilities that he deems necessary in accordance with the Health and Safety (First Aid) Regulations 1981.
3.8. The Hirer will be responsible for the selection and supervision of all third parties it engages to provide services for the event, including ensuring that such third parties have in place sufficient risk assessments and insurance to cover their liabilities.
3.9. The Hirer shall ensure that all contact details provided at the time of hiring are accurate. The Council shall not be responsible for any losses that result from a failure to provide accurate details.
3.10. The information supplied by the Hirer shall be used to process the hiring. The Hirer acknowledges that the Council is legally bound to comply with the Data Protection Xxx 0000 (DPA) and the Freedom of Information Xxx 0000 (FOIA) and every person who enters into an agreement with the Council is subject to the Council’s rights and duties under the DPA and FOIA. Operational Conditions. Breakdown repairs will be logged with Council’s elected representatives and the appointed service providers will receive an e-mail detailing the required services, location, contact person and a description of the breakdown/malfunction where possible. Final rates will be decided prior to contract commencement and a job card must accompany all invoices for breakdown repairs. Bidders must obtain approval from Council’s elected representative before procuring any specialist skills needed to execute any aspects of the contract that may require such expertise. All service providers must comply with all applicable Health and Safety Act and regulations at own cost and Council is empowered to provide any tools and equipment to the employees of a service provider and invoice the service provider for provision of same.
